📄 Listcord Terms of Service

1. Acceptance of These Terms

By accessing listcord.com, installing or interacting with the Listcord Discord bot, or otherwise using any Listcord service (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Eligibility & Authority

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) and have the legal authority to bind the Discord server or organization you represent. By adding the Listcord bot, you confirm that you are the server owner or have been authorized by the owner to do so.

3. Account & Authentication

1. Discord OAuth2. You sign in through Discord; Discord handles authentication.
2. Accuracy. You promise that all information you provide is accurate and up to date.
3. Security. Keep your Discord credentials secure. Listcord is not liable for unauthorized use of your Discord account.

4. Server Listings & User Content

1. User Content. “User Content” means any data you send us—server metadata, images, text, keywords, descriptions, and so on.
2. Responsibility. You are solely responsible for your User Content and any harm resulting from it.
3. Prohibited Content. You may not post or promote:
   • illegal or infringing content;
   • hate speech, harassment, or violent threats;
   • content promoting division, hate, or politics;
   • sexual or explicit content involving minors;
   • malicious code, spam, or scams; or
   • content that violates Discord’s Terms of Service or Community Guidelines.
   Listcord may remove or refuse any listing at its sole discretion.

5. License You Grant to Listcord

You grant Listcord a worldwide, non‑exclusive, royalty‑free license to host, display, and distribute your User Content for the purpose of operating, improving, and promoting the Service. This license ends when you delete the content or request removal (see § 11).

6. Use of the Listcord Bot

1. Heartbeat & Stats. Running /send heartbeat transmits updated server stats that are publicly shown on listcord.com.
2. Rate Limits. Excessive or abusive bot usage may result in throttling or a ban.
3. Compliance. The bot must be invited and used only in compliance with Discord’s SDK and Terms.

7. Prohibited Conduct

You agree not to:

• violate any applicable law;
• reverse‑engineer, decompile, or hack the Service;
• interfere with servers, networks, or security features;
• harvest or scrape data from Listcord without written permission; or
• impersonate Listcord or misrepresent your affiliation.

8. Intellectual Property

Except for User Content, the Service and all trademarks (including “Listcord”) are owned by ChatWith.Support LLC or its licensors and protected by U.S. and international IP laws.

9. Third‑Party Links & Content

Listcord displays Discord invite links and may contain links to other sites. We do not endorse or control third‑party content and are not responsible for it. Your dealings with third parties are solely between you and them.

10. Fees & Monetization

The core directory is currently free. We may introduce paid features (e.g., promoted placements) in the future. Any new fees will be disclosed before you incur charges.

11. Termination & Content Removal

1. By You. Remove the bot and email a data‑removal request (see Privacy Policy).
2. By Us. We may suspend or terminate your access or remove any listing at any time for any reason.
3. Effect. Sections that by nature should survive (e.g., disclaimers, limitations, indemnities) remain in effect.

12. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE.” We make no warranties—express or implied—about uptime, accuracy, or fitness for any purpose. You use the Service at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law, Listcord and ChatWith.Support LLC will not be liable for any indirect, incidental, special, consequential, or exemplary damages. Our total liability for any claim is limited to USD $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless Listcord and ChatWith.Support LLC from any claims or damages arising from your use of the Service, your User Content, or your breach of these Terms.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Texas, USA. Any litigation must be brought in the state or federal courts located in Kaufman County, Texas.

16. Dispute Resolution (Arbitration)

If informal resolution fails, either party may elect binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association. You waive your right to a jury trial and to participate in class actions.

17. Modifications to Terms or Service

We may modify these Terms or the Service at any time. Material changes will be posted with a new “Last updated” date. Continued use after changes means you accept the revised Terms.

18. Severability

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Listcord regarding the Service and supersede prior agreements.
